Last Will and Testament
Many times this is the most forgotten document, but yet, it can be the most important to have and to update. A Last Will and Testament is a written document that dictates how your property is to be distributed to your chosen heirs as well as other issues (i.e. funeral arrangements, appointment of a personal representative, guardian for minor children, etc.). If you die without a will, also known as intestate, then Florida Statute 732 controls how your estate is divided up. Whenever there is a marriage or divorce, you should update your will.

Living Will
A living will is a written document that dictates your wishes in advance regarding important health care issues, such as if you are ever on life support or incapacitated. It is usually provided to your doctor and personal representative in advance in case something happens.

Health Care Surrogate
This is a very important document, which provides who is to carry out your wishes provided in your living will, which should be someone you trust to follow through with your wishes provided in the Living Will. If there is not a living will, Florida Statute will dictate who this person will be.

General Power of Attorney
This is a written document that allows you to appoint someone you trust to manage important legal and financial matters for you. It can be effective immediately or upon a specific event, such as you being incapacitated. This document is used quit a bit with military members while they are deployed so that their spouse, parents or other trusted person can manage his or her affairs. This document should not be taken lightly since it gives someone authority to make decisions regarding your money.

Overview
It is recommended that you have all four documents so that your desires are known and you control what happens to your property as well as your life in a medical emergency.
