Probate
Probate law is the branch of law dealing with a deceased individual’s estate: settling and distributing it among beneficiaries. The primary goal of the probate process is to review and affirm the validity and authenticity of a will. If there is no will, the court will then act to arrange the distribution of assets and property.
There are three steps involved in the probate process:
- Collection – all property and assets must be collected and organized.
- Payment – any outstanding debts are paid using the assets collected in the first step.
- Distribution – remaining assets and property are distributed among beneficiaries, either named in the will, or when no will is present, as decided by the court.
Probate can be a complicated and lengthy process, lasting anywhere from several months up to a year. In addition, it can be an emotionally trying time for friends and family members involved. The lack of a will only complicates matters further, creating the need to ensure important family members are not left out and that the distribution of assets is fair.
